Important: These Terms of Use and Privacy Policy apply to HiApartmentHomes, a rental-listing and advertising platform operated by Upper Genius LLC. By accessing or using HiApartmentHomes, you acknowledge that you have read and agree to the applicable provisions below.

Terms of Use

1. Acceptance of these Terms

These Terms of Use (“Terms”) are a binding agreement between you and Upper Genius LLC, doing business as HiApartmentHomes (“HiApartmentHomes,” “we,” “us,” or “our”). They govern your access to and use of hiapartmenthomes.com, your account, and the features and services made available through the website (collectively, the “Platform”).

By accessing or using the Platform, creating an account, purchasing a listing pass or membership, submitting a property, communicating with another user, or applying for a rental, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. What HiApartmentHomes Does

HiApartmentHomes provides tools that allow visitors to browse rental opportunities and allow independent property owners, landlords, property managers, agents, authorized representatives, and other advertisers (“Advertisers”) to publish listings, receive inquiries, and manage rental-related activity.

Unless we expressly state otherwise for a specific property, HiApartmentHomes:

• does not own, lease, manage, inspect, or control advertised properties;
• is not a landlord, tenant, real-estate broker, property manager, lender, insurer, screening agency, or legal representative of any user;
• is not a party to a lease, rental agreement, application decision, deposit, payment, or other transaction between users;
• does not guarantee the identity, authority, honesty, or conduct of any user;
• does not guarantee that a listing is accurate, available, lawful, verified, or suitable; and
• does not guarantee inquiries, application approval, occupancy, rental income, or any other result.

Users must independently verify property details, ownership or authorization, pricing, availability, lease terms, fees, identities, and payment instructions before proceeding with a rental transaction.

3. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase a service. The Platform is intended primarily for use in the United States.

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your username, password, and account access and for activity performed through your account. Notify us promptly through our contact page if you believe your account has been accessed without permission.

You may not impersonate another person, misrepresent your authority, create accounts to evade restrictions, sell or transfer your account, or use another user’s account without authorization.

4. Rental Listings and Advertiser Responsibilities

Advertisers are solely responsible for their listings and rental activities. By submitting or publishing a listing, you represent and warrant that:

• you own the property or have the legal authority and required permission to advertise it;
• all descriptions, prices, availability dates, addresses, photographs, amenities, rules, fees, and other details are accurate and not misleading;
• you will keep the listing current and promptly mark it unavailable or remove it when appropriate;
• you have the necessary rights and permissions for all submitted photographs, text, logos, and other content;
• the property and rental activity comply with applicable leases, homeowner-association rules, licenses, permits, zoning requirements, and other obligations; and
• you will comply with all applicable housing, advertising, privacy, screening, consumer-protection, and anti-discrimination laws.

Advertisers—not HiApartmentHomes—are responsible for establishing rental criteria, screening applicants, making rental decisions, providing legally required notices, safeguarding application records, handling deposits or rent, and fulfilling landlord or property-management obligations.

5. Fair Housing and Non-Discrimination

HiApartmentHomes supports equal housing opportunity. Users may not publish listings, screening criteria, preferences, messages, or other content that unlawfully discriminates against or indicates an unlawful preference or limitation concerning a protected class. Users are responsible for understanding and complying with all applicable federal, state, and local fair-housing and anti-discrimination requirements.

We may remove content, restrict features, or suspend accounts when we reasonably believe activity may violate these requirements.

6. Renter and Applicant Responsibilities

Renters and applicants are responsible for reviewing listings carefully, asking questions, independently verifying the property and Advertiser, and deciding whether to proceed. Information submitted in an inquiry or application must be accurate and must not be fraudulent, misleading, or unlawfully obtained.

Never send money or sensitive information until you have verified the property, the recipient’s identity and authority, the written terms, and the legitimacy of the request. Be especially cautious with gift cards, cryptocurrency, wire transfers, cash, or other difficult-to-reverse payment methods.

7. Memberships, Listing Passes, Billing, and Renewal

Some features are free, while others require a paid membership, listing pass, or other purchase. Current prices, billing periods, renewal terms, listing limits, included features, and eligibility requirements are displayed on the applicable pricing or checkout page and are incorporated into these Terms.

By purchasing a recurring membership, you authorize the applicable payment provider to charge the disclosed amount and applicable taxes at the stated interval until you cancel. You may cancel future renewal using available account controls or by contacting us. Unless the checkout terms state otherwise, cancellation stops future renewal and does not automatically refund a charge already processed.

One-time listing passes do not automatically renew unless expressly disclosed at checkout. Listing duration, publication limits, and included features are determined by the plan purchased.

We may change future pricing or plan features. Changes to recurring charges will be communicated as required by applicable law and will apply prospectively. Paid features do not guarantee listing approval, placement, visibility, inquiries, applications, occupancy, or income.

Except where required by law or expressly stated in a written refund policy or at checkout, fees are non-refundable once the applicable service or access has been provided.

8. Member Rewards, Earnings, and Payouts

If the Platform offers an eligible member-reward, referral, submission, or earnings program, the requirements, available balance, minimum payout threshold, processing fees, supported payout methods, and status of qualifying activity will be shown in the member dashboard or applicable program rules.

Displayed pending amounts are not payable until the associated activity satisfies the program requirements and is marked eligible, approved, or completed. We may review, reject, reverse, withhold, or delay amounts associated with errors, duplicate activity, refunds, chargebacks, policy violations, suspected fraud, unlawful activity, or activity that does not satisfy program requirements.

Participating members act as independent contractors and are not employees, agents, partners, or representatives of HiApartmentHomes. Members are responsible for their own taxes, insurance, licenses, records, and legal obligations. Participation does not guarantee assignments, approval, earnings, or a minimum amount of work.

9. Content Standards

You retain ownership of content you submit. You grant HiApartmentHomes a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and use that content as reasonably necessary to operate, promote, secure, and improve the Platform. This license ends when the content is deleted, except for reasonable backup retention, legal obligations, and content already shared or used as permitted before deletion.

You may not submit content that:

• is false, misleading, fraudulent, defamatory, threatening, harassing, hateful, obscene, or unlawfully discriminatory;
• infringes intellectual-property, privacy, publicity, contractual, or other rights;
• contains malware, harmful code, unauthorized advertising, spam, or deceptive links;
• promotes an unlawful transaction or misrepresents a property, price, identity, or authority;
• includes personal or confidential information you lack authority to disclose; or
• otherwise violates these Terms or applicable law.

We may review, refuse, edit for formatting, limit, unpublish, or remove content, but we are not obligated to monitor every submission.

10. Acceptable Use

You may not misuse the Platform, interfere with its operation, attempt unauthorized access, scrape or harvest data without written permission, bypass security or access controls, reverse engineer protected components, overload the Platform, use automated tools in a disruptive manner, or use the Platform to facilitate fraud, harassment, discrimination, or other unlawful conduct.

11. Communications Between Users

Users are responsible for their communications and interactions. HiApartmentHomes may provide inquiry, messaging, application, or contact tools but does not control or endorse user statements. Use professional, respectful, and rental-related communications. Do not pressure another user to provide unnecessary sensitive information or use an unsafe payment method.

12. Third-Party Services and Links

The Platform may link to or integrate with third-party services, including payment processors, social-login providers, maps, analytics tools, email providers, hosting services, and property-related resources. Third parties operate under their own terms and privacy policies. We do not control and are not responsible for third-party services, availability, content, security, or conduct.

13. Intellectual Property

Except for user content, the Platform and its software, design, branding, text, graphics, logos, and other materials are owned by or licensed to HiApartmentHomes and are protected by applicable intellectual-property laws. These Terms provide a limited, revocable, non-exclusive, non-transferable right to use the Platform for its intended purpose. They do not transfer ownership of any intellectual property.

14. Suspension and Termination

We may restrict, suspend, or terminate access; decline or remove a listing; withhold publication; or take other reasonable action if we believe an account or activity violates these Terms, threatens users or the Platform, creates legal or security risk, involves suspected fraud, or may harm HiApartmentHomes or another person.

You may stop using the Platform at any time. Provisions that by their nature should survive termination—including payment obligations, licenses already granted, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain effective.

15. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIAPARTMENTHOMES DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from harmful components, or that listings, users, applications, communications, or results will be accurate, legitimate, available, or satisfactory. Nothing on the Platform is legal, financial, housing, tax, or professional advice.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIAPARTMENTHOMES AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; OR LOSSES ARISING FROM USER CONDUCT, LISTINGS, RENTAL TRANSACTIONS, PROPERTY CONDITIONS, PAYMENTS, THIRD-PARTY SERVICES, OR UNAUTHORIZED ACCOUNT ACCESS.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HiApartmentHomes and its owners, affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your content, listing, rental activity, violation of these Terms, violation of law, infringement of another person’s rights, or misuse of the Platform.

18. Changes to the Platform or Terms

We may update the Platform and these Terms. Material changes will be posted with a revised effective date and, when required, additional notice. Continued use after revised Terms become effective constitutes acceptance of those Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Before filing a claim, you and HiApartmentHomes agree to attempt in good faith to resolve the dispute informally by providing written notice and allowing a reasonable opportunity to respond. Unless applicable law requires otherwise, disputes will be brought in a court of competent jurisdiction in North Carolina.

20. General Terms

These Terms and incorporated policies constitute the entire agreement concerning the Platform. If a provision is found unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent. We may assign these Terms as part of a merger, reorganization, sale, or transfer of the Platform or business.

Privacy Policy

1. Scope

This Privacy Policy explains how Upper Genius LLC, doing business as HiApartmentHomes, collects, uses, discloses, and protects information when you visit or use the Platform. It applies to visitors, registered members, renters, applicants, Advertisers, and participants in eligible reward or referral programs.

This policy does not govern information an independent Advertiser collects or processes outside the Platform. Advertisers are independently responsible for their own privacy practices and legal obligations.

2. Information We Collect

Depending on how you use the Platform, we may collect:

• Account information: name, username, email address, telephone number, account type, profile information, login credentials, and preferences.
• Listing information: property address, pricing, availability, descriptions, features, photographs, contact details, and information about the Advertiser’s authority.
• Inquiry and application information: messages, contact information, application responses, documents, and other information you choose to submit through supported features.
• Membership and transaction information: plan, purchase, renewal, billing status, payout status, transaction identifiers, and limited payment-related details supplied by payment providers. We generally do not receive complete payment-card credentials.
• Rewards and referral information: referral codes, link visits, share activity, signups, qualifying submissions, balances, payout requests, and related records.
• Device and usage information: IP address, browser, device type, operating system, referring pages, pages viewed, interactions, approximate location derived from IP, timestamps, errors, and security events.
• Communications: support requests, reports, feedback, survey responses, and email or notification preferences.
• Cookies and similar technologies: identifiers used for sessions, preferences, security, analytics, functionality, and, when enabled with appropriate notice or consent, advertising.

3. How We Collect Information

We collect information directly from you, automatically from your browser or device, from other users when they interact with you through the Platform, and from service providers that support authentication, payments, maps, analytics, communications, security, hosting, and other Platform functions.

4. How We Use Information

We may use information to:

• provide, operate, maintain, personalize, and improve the Platform;
• create and secure accounts and authenticate users;
• publish and manage listings, inquiries, applications, messages, memberships, referrals, rewards, and payouts;
• process purchases and maintain transaction records;
• communicate about accounts, listings, activity, support, safety, policies, and service changes;
• send marketing or rental updates when permitted and honor unsubscribe choices;
• measure usage, troubleshoot errors, develop features, and understand Platform performance;
• detect, investigate, and prevent fraud, abuse, discrimination, security incidents, and policy violations;
• enforce agreements and protect users, HiApartmentHomes, and the public; and
• comply with legal, tax, accounting, reporting, and regulatory obligations.

5. How We Disclose Information

We may disclose information:

• To other users: listing and profile information is displayed as part of the Platform, and inquiry or application information is shared with the intended Advertiser or recipient.
• To service providers: companies supporting hosting, security, payments, authentication, maps, analytics, email, customer support, storage, and other technical or business operations may process information for us under appropriate restrictions.
• For legal and safety reasons: when reasonably necessary to comply with law or legal process, enforce policies, investigate misconduct, prevent harm, protect rights or property, or respond to lawful government requests.
• In a business transaction: in connection with a financing, merger, acquisition, reorganization, sale of assets, or similar transaction, subject to applicable law.
• With your direction or consent: when you request or authorize the disclosure.

Public listings may be viewed, copied, or shared by visitors and search engines. Do not publish information you do not want publicly available.

6. Applications and Sensitive Information

Rental applications may contain sensitive personal information. Submit only information requested for a legitimate rental purpose and verify the intended recipient before submitting. Advertisers who receive applicant information must use it only for legitimate rental purposes, restrict access, protect it appropriately, retain it only as necessary, and comply with applicable screening, privacy, recordkeeping, and disposal laws.

Do not submit Social Security numbers, bank credentials, government-identification images, medical details, or other highly sensitive information unless a clearly identified and secure Platform feature specifically requests it and you have verified the purpose and recipient.

7. Cookies and Analytics

We use essential cookies for login sessions, security, preferences, and core functionality. We may also use analytics or advertising technologies where enabled. Browser settings and any available cookie controls can be used to manage certain technologies, but disabling essential cookies may prevent parts of the Platform from working.

8. Payments

Payments and payouts may be handled by third-party payment providers. Those providers collect and process payment or financial information under their own privacy policies and legal obligations. HiApartmentHomes may receive transaction status, limited account details, identifiers, and records needed to provide services, prevent fraud, maintain accounts, and satisfy legal obligations.

9. Data Retention

We retain information for as long as reasonably necessary to provide the Platform, maintain business and transaction records, resolve disputes, enforce agreements, prevent fraud, satisfy legal obligations, and protect rights and security. Retention varies by the type of information and reason for processing. Information may remain in backups for a limited period after deletion.

10. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information. No website, database, transmission, or storage system can be guaranteed completely secure. You are responsible for using a strong password, protecting your devices, and notifying us of suspected unauthorized access.

11. Your Choices and Requests

Depending on available account tools and applicable law, you may review or update account information, manage communications, cancel membership renewal, request account deletion, or ask about access to or correction of personal information.

Marketing emails include an unsubscribe method. Unsubscribing from marketing does not prevent necessary transactional, security, support, or policy communications.

Submit privacy requests through our contact page. We may verify your identity and authority before completing a request. Certain information may be retained or excluded from a request when permitted or required by law.

12. Children’s Privacy

The Platform is not directed to children under 18, and we do not knowingly permit children under 18 to create accounts or purchase services. If you believe a child has provided personal information, contact us so we can review the matter.

13. Third-Party Sites and Services

The Platform may contain links to or integrations with third parties. Their privacy practices are governed by their own policies, not this Privacy Policy. Review those policies before providing information.

14. United States Operations

HiApartmentHomes operates in the United States. Information may be processed and stored in the United States and other locations where our service providers operate, subject to applicable law and appropriate safeguards.

15. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes in the Platform, our practices, or legal requirements. The revised version will be posted with an updated effective date. When required, we will provide additional notice.
